
Collection Agreement Terms and Conditions
The Customer confirms that the Customer has initiated contact with Roll our Greens to provide the Service or to receive more information regarding the Service.
The Customer has selected the Service as either a Once-Off Service or a Monthly/Bi-Monthly Service and has agreed to the Permitted Use.
Roll Your Greens has made no representations with regards to the suitability or not of the Service or the Bag for the Customer's intended use.
Roll Your Greens provides the Service to the Customer, at the Contract Cost for the Permitted Use, selected by the Customer.
The Customer will use the Bag in accordance with the Bag's Permitted Use and only as directed by the User Guide. The Customer accepts responsibility for informing all users of the Bag of the contents of the User Guide.
If Excluded Waste is found in a Bag, the Excluded Waste surcharge of $120 will apply and Roll Your Greens reserves the right to refuse to collect, dispose or remove the Bag and/or its contents. Should Roll Your Greens be unable to remove the Bag or salvage any component of the Bag, the Customer will be charged and liable to pay to replace the Bag or any component of the Bag as per Roll Your Greens's price list.
If the customer elects to terminate the service after only one collection, early termination fees may apply.
The Once-Off Service will not commence unless Roll Your Greens is in receipt of the Deposit, together with an amount equal to the cost of one collection, from the Customer.
The Customer will ensure that the Collection Point is accessible to Roll Your Greens daily between 6am and 6pm. If Roll Your Greens is unable to provide the collection service because the Bag is not accessible, and a cancellation notice not given prior to collection day/date, then the normal collection fee will apply and the collection will be rescheduled for the next available service date.
It is the responsibility of the Customer to ensure that Roll Your Greens is paid for the Service no less than 7 days prior to a scheduled Monthly/Bi-Monthly collection of the Bag, such payment to be made electronically into the nominated Bank Account. If you choose to pay by cash then payment is to be received on the scheduled collection day
It is the responsibility of the Customer to provide Roll Your Greens notice in writing (email rollyourgreens@gmail.com) no less than 30 days prior to a scheduled collection of the Bag, to cancel the Service.
Roll Your Greens will provide the service in accordance with the Collection Agreement whether the Bag is filled to capacity or not.
Roll Your Greens may increase the price of the service or any related service or products by providing the Customer 30 days notice in writing (email acceptable). Should the Customer fail to Terminate the Service in accordance with the Collection Agreement then the increased fees are deemed to be acceptable to the Customer and the Service will continue at the increased prices from the effective date of the price increases.
The Customer or Roll Your Greens can Terminate the Collection Agreement, by one party providing 30 days written notice (email acceptable) of termination to the other.
The Customer agrees that the Termination Fee and terms to Terminate are fair and reasonable. The Customer will return or make available for collection by Roll Your Greens the Bag on cancellation of the Collection Agreement or early Termination of same.
Roll Your Greens will maintain its Public Liability insurance and will ensure that its employees have Police Clearance before employment.
The Customer agrees that Roll Your Greens may transfer, sell, license or assign Roll Your Greens rights under this Collection Agreement to a third party to provide the Service to the Customer.
The Customer is responsible to insure the Bag against loss and damage.
Roll Your Greens does not take responsibility or accept any liability for any personal or property loss or damage suffered by the Customer or any third party, in relation to providing its Service or the Bag to the Customer.
Roll Your Greens will place the Bag within the boundary of the Customer's premises on each occurrence the Service is provided. The Customer accepts responsibility to store the Bag in a safe location on the Customer's premises.
Roll Your Greens is unable to take any bags that contents are a result of seasonal Lawn Reno's ie. thatching, scarifying or coring due to the sand content and weight.
“Bag" means:
A solid or woven container that may include its supporting frame or transport device, all of which components remains the property of Roll Your Greens, that is made available to the Customer at the Collection Point, for the Permitted Use only, after receipt by Roll Your Greens of the Deposit.
“Collection Point” means:
The accessible area mutually agreed to by the Customer and Roll Your Greens , as the place on the Customer's premises where the Bag will be placed and from where Roll Your Greens will collect the Bag in accordance with the Collection Agreement. In your absense, we will deliver / pickup from the front yard, unless directed otherwise.
“Collection Agreement” means:
This agreement between Roll Your Greens and the Customer which sets out the terms and conditions for providing the Service, the number of Bag collections, the cost of each Bag collection, the total Contract Cost and the Permitted Use. Executed by the Customer b transfer of first payment and trolley and bag delivery
“Collection Cost” means:
The cost per collection to provide the Service.
“Contract Cost” means:
The cost of providing the Service for the agreed number of collections as per the Collection Agreement.
“Customer” means:
The person or entity engaging Roll Your Greens to supply the Service.
“Customer Number” means:
A unique identifying number provided by Roll Your Greens to the Customer.
“Deposit” means:
The amount specified in the Collection Agreement as security for loss that Roll Your Greens may suffer in relation to the Once- Off Service or damage, loss or repossession of the Bag or components of the Bag. No interest will incur for the benefit of the Customer on the Deposit.
“Excluded Waste” means:
Lead, paint and/or paint cans, gas and/or gas canisters and/or equipment, asbestos, oil and/or flammables, pets and/or droppings, rubber, food-waste, glass, batteries, plastics and other synthetics.
“Builders Waste” means:
Sand, soil, rocks, cement, tiles, paper and cardboard, metals other than Excluded Waste.
“Green Waste” means:
Garden refuse such as grass clippings, weeds, pruning's, branches less than 10cm in diameter, logs not longer than 30cm, leaves, plants none of which contains Builders Waste or Excluded Waste. Green Waste may not exceed Bag capacity or weight of 200kg or have the garden waste protruding from the top of the bag to prevent the closure of the bag flaps for removal of bag.
“Permitted Use” means:
Disposal, by the Customer, of either Green Waste or Builders Waste as selected by the Customer on the Collection Agreement, into the Bag. Green Waste cannot include Builders Waste or Excluded Waste, or penalties may apply.
“Service” means:
The placement of a Bag at the Customer's Collection Point for the Permitted Use and the collection of the Bag in accordance with the Collection Agreement or as directed by the Customer in which event additional charges may apply.
“Terminate” means:
Termination of the Service by either the Customer or Roll Your Greens.
“User Guide” means:
The guide provided by Roll Your Greens to the Customer on the day of installation of the Bag at the Customer's premises or as published on Roll Your Greens's website, which sets out the guidelines and rules for the safe use of the Bag by the Customer.
